On March 7, the U.S. Senate approved H.J. Resolution 37, which would nullify a rule issued by the Department of Defense, the General Services Administration, and the National Aeronautics and Space Administration on August 25, 2016, implementing President Obama’s Executive Order on Fair Pay and Safe Workplaces. President Trump will likely approve the measure.
The rule would have required prospective federal contractors to disclose any violations during the prior three years of laws and rules regulating wage and hour, safety and health, collective bargaining, family and medical leave, and civil rights. It would also have barred federal contractors from enforcing mandatory pre-dispute arbitration agreements for claims regarding sexual assault or civil rights violations.
Additionally, if approved, the resolution will prevent implementation of the paycheck transparency requirements.
