The Federal Motor Carrier Safety Administration’s (FMCSA) Final Rule establishing the Commercial Driver’s License Drug and Alcohol Clearinghouse became effective last week. Note that while it is technically “effective,” employers will not need to comply until January 2020.
The Clearinghouse will be a searchable database that will contain information regarding violations of the U.S. Department of Transportation’s drug and alcohol testing regulations by Commercial Driver’s License holders.
The Final Rule requires FMCSA-regulated employers, Medical Review Officers, Substance Abuse Professionals, and others to report violations of the FMCSA’s drug regulations to the Clearinghouse.
As of January 2020, the Final Rule will require employers to query the Clearinghouse for current and prospective employees’ drug and alcohol violations before permitting those employees to operate a commercial motor vehicle (CMV) on public roads. It will also require employers to query each currently employed driver annually.
