The City Council of Los Angeles has passed the Fair Chance Initiative, which is currently awaiting approval from Mayor Eric Garcetti. The ordinance prohibits employers with 10 or more employees from including on an employment application any question seeking disclosure of an applicant’s criminal history. In fact, employers are prohibited from inquiring into an applicant’s criminal history until a conditional offer of employment has been made. In addition, employers are limited in taking adverse employment action based on an individual’s criminal history and must follow a “fair chance process.” Employers will have posting requirements, as well.
