California, Maine, Nevada, and Massachusetts voted to legalize recreational marijuana yesterday, while Arizona rejected its own legal marijuana initiative, Proposition 205. Prior to the election, marijuana, which remains illegal under federal law, was legal under the state laws of Colorado, Alaska, Oregon, Washington, and Washington, D.C.
Voters in Florida, North Dakota, and Arkansas approved medical marijuana measures.
Both the California and Nevada ballot measures state that employers will have the ability to enact and enforce policies regarding marijuana; however, it remains to be seen whether employers in those states will have the level of discretion Colorado employers currently enjoy. An October Gallup Poll found that a majority of Americans now favor marijuana legalization.
