Colorado employers may be interested in two upcoming hearings.
On Thursday, October 20, 2016, the Colorado Department of Labor and Employment will hold a hearing prior to adopting amendments affecting unemployment. Interested parties can attend the hearing and testify or submit written data, views, arguments, or position papers at least five days prior to the hearing. The proposed amendments are as follows:
Registration and Filing Claims. Amend rules to clarify what factors are considered when an individual who has an unemployment claim fails to act in a timely manner.
Week of Unemployment. Amend rules to clarify what factors are considered when an individual who has an unemployment claim fails to act in a timely manner.
Approved Training Course. To delete rules that applied to C.R.S. § 8-73-114, because that section of law was repealed. Also, to add a new rule allowing the Director of the Division to waive consideration of requirements associated with approved training in instances when an industry crisis threatens the regional or state economic stability.

On Tuesday, November 1, 2016, the Colorado Division of Labor Standards and Statistics (Division) will hold a public hearing on the following proposed regulatory changes:
Rules of Procedure to the Colorado Labor Peace Act and Industrial Relations Act, 7 C.C.R. 1101-1. The proposed amendments to the rule clarify the petition process for union elections required under the Act.
Colorado Minimum Wage Order Number 33, 7 C.C.R. 1103-1. Colorado Minimum Wage Order Number 33 adjusts the new state minimum wage per inflation to $8.56 per hour, and makes a minor change to the paragraph prior to the Table of Contents.
Employment Opportunity Act Rules, 7 C.C.R. 1103-4. The proposed amendments to the rule clarify the hearing procedures.
Social Media and the Workplace Law Rules, 7 C.C.R. 1103-5. The proposed amendments to the rule clarify the hearing procedures.
Keep Jobs in Colorado Act Rules, 7 C.C.R. 1103-6. The proposed amendments to the rule clarify the hearing procedures.
Wage Protection Act Rules, 7 C.C.R. 1103-7. The proposed amendments to the rule supplement and clarify the statutory language and provide a step-by-step guide to the Division’s wage complaint process.
In addition, the Division is proposing a repeal of the Employment Verification Law Rules 7 C.C.R. 1103-3 in accordance with House Bill 16-1114, which amended C.R.S. § 8-2-122, and eliminated the Division’s authority to issue fines.
