MSEC has received several calls from sharp-eyed members pointing out that the current Family and Medical Leave Act forms supplied by the U.S. Department of Labor (DOL) expire at the end of this month. The DOL assures us the forms are still suitable for use:
“With regard to FMLA form expiration … forms available on the … website may show expiration dates that have already passed. This may occur when forms have been submitted to the Office of Management and Budget (OMB) and are awaiting renewal. [We] will continue to accept and use the expired forms while their renewal is pending at OMB,” the DOL said in response to an email inquiry.
Note that the forms are provided for employers’ convenience, and their use—expired or not—is not mandatory.
