The Office of Federal Contract Compliance Programs (OFCCP) issued its first set of Corporate Scheduling Letters (CSALs) for 2014 on January 31. CSALs are courtesy notifications from the OFCCP to establishments selected for compliance reviews during the scheduling cycle. The CSAL’s purpose is to notify contractors of the complaince review so they can perform self-audits or seek assistance to find and fix problems beforehand. The OFCCP sends CSALs directly to the location that is subject to the compliance review and addresses them to the attention of the “Human Resources Director.” If you are an affirmative action employer, we recommend that you notify your locations to lookout for these notices.
Recipients of this first round of CSALs have over a 90 percent chance of receiving a Notice of Compliance Review, which starts the complaince review process, from the OFCCP. However, a location can still be subjected to an OFCCP compliance review absent a CSAL.
The OFCCP will send a Notice of Compliance Review to locations selected for audit. The Notice of Compliance Review notifies the company that the establishment has 30 days to submit its affirmative action plan to the OFCCP’s regional office.
If your organization received a CSAL, this is a good opportunity to:
notify appropriate personnel of upcoming compliance reviews for the locations specified in the CSAL,
ensure that compliant affirmative action plans are in place for the specified locations,
review any potential issues that are likely to cause problems during an OFCCP review, particularly adverse impact in hiring and compensation disparities, and
take affirmative steps to remedy deficiencies.
