Arizona Attorney General Tom Horne has filed a lawsuit against the U.S. Department of Justice and other defendants on behalf of the State of Arizona and Gov. Jan Brewer.
The lawsuit seeks a ruling on whether those involved with medical marijuana remain at risk for prosecution under federal criminal law, even if they are in strict compliance with Arizona state medical marijuana law.
The lawsuit was prompted by a May 2 letter from U.S. Attorney Dennis Burke in which Burke stated that because marijuana remains illegal under federal law, criminal prosecutions could take place. Gov. Brewer has expressed concerns that state employees could face criminal prosecution for regulating the program.
